All content, features, and functionality on the services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of Sandwarmfoo or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal or internal business purposes. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

Any unauthorized use terminates the permission or license granted by Sandwarmfoo. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our services, except as follows: your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

6. User-Generated Content

You represent and warrant that you own or have the necessary rights to the User-Generated Content you submit and that such content does not violate any third-party rights, including intellectual property rights, privacy rights, or any other rights. You are solely responsible for your User-Generated Content and the consequences of submitting it.

Sandwarmfoo reserves the right to monitor, review, and remove any User-Generated Content at our sole discretion, without notice, for any reason, including if we believe that such content violates these Terms or is otherwise objectionable.

7. Payment Terms

Access to certain features of our services may require payment of fees. By subscribing to our services, you agree to pay all applicable fees as outlined on our website. All fees are non-refundable unless otherwise stated. You are responsible for providing accurate billing information and for ensuring that your payment method is valid and up to date.

Fees may be subject to change, and we will notify you of any changes in advance. If you fail to pay any fees when due, we reserve the right to suspend or terminate your access to the services until payment is received. You agree to pay any costs incurred by Sandwarmfoo in collecting overdue amounts, including reasonable attorney's fees.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Sandwarmfoo, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In no event shall Sandwarmfoo’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

10. Termination

These Terms are effective until terminated by either party. You may terminate these Terms at any time by discontinuing your use of the services and deleting your account. Sandwarmfoo may terminate or suspend your access to the services immediately, without prior notice or liability, if you breach these Terms or engage in any conduct that we believe is harmful to Sandwarmfoo, the services, or other users.

Upon termination of your account, your right to use the services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right to modify or terminate the services for any reason, without notice, at any time. You agree that Sandwarmfoo shall not be liable to you or any third party for any termination of your access to the services.
